WARRANTY GUARANTEE
CONSPRO CORP. warrants, subject to the terms and limitations hereof, that the Bull-Bond® Pro One™ will Five (5) for a period of [number of years] years from the date of purchase when applied in accordance with all application procedures outlined in the product’s technical data sheets. Failure to follow all currently published installation instructions will render the warranty null and void. If any material is found defective or not usable, CONSPRO CORP. will promptly replace the defective material to the purchaser or refund the purchase price.
CONSPRO CORP.’S LIALITY
CONSPRO CORP.’s liability is strictly limited to refund the purchase price or to replace the defective material with an equal or similar product.
WARRANTY REGISTRATION
For this warranty to be valid, the building owner must complete and redeem a warranty application form, located at www.bullbond.com/warrantyproone , within thirty (30) days of the purchase date. If warranty application is not returned within thirty (30) days of purchase, user waives all rights under the warranty and will not be entitled to warranty claims of any sort.
NOTIFICATION OF CLAIM
All defective product claims must be received in writing within 30 days of the discovery of the fault. No claims will be considered without such written notice, without the corresponding warranty application, or after the specified time interval. CONSPRO CORP. will promptly investigate all properly reported claims. Our investigator will prepare a written/oral report describing the nature of the problem and an explanation for the reported difficulties. An authorized officer of CONSPRO CORP. will handle all complaints and resolve any pending problems after this point.
LIMITED WARRANTY RENEWAL
This warranty is renewable at the option of the Building Owner. To qualify for warranty renewal, Building owner must contact CONSPRO CORP. and request an inspection no later than 180 days prior to the expiration of the warranty term. A representative of CONSPRO CORP. will inspect the Product installation and condition and will recommend the recoats and/or repairs necessary for warranty renewal. Once the actions outlined in CONSPRO CORP.’s recommendation are completed, Building Owner may request the renewal of the warranty. This warranty may be renewed throughout the lifetime of the building. Failure to contact CONSPRO CORP. to request the required inspection or requesting a renewal outside the warranty term voids the renewable aspect of the warranty. Warranty is only renewable as long as renewals have occurred sequentially throughout the lifetime of the product.
WARRANTY EXCLUSIONS
Warranty is invalidated by poor workmanship not in accordance with written product installation instructions, product installation guidelines and applicable industry standards. Owner is responsible for routine maintenance. CONSPRO CORP. is not responsible for normal wear and tear resulting from regular usage or for warranty claims involving product abuse or misuse. Warranty does not cover damage or defects resulting from:
- Natural disasters, vermin or acts of God,
- Misuse, abuse or negligence,
- Lack of maintenance,
- Standing or pooling water,
- Fire, faulty construction or design, inadequate drainage or other failure of the structure,
- Failure of the building substrate,
- Defects, blisters or delamination in the materials, substrate, coating or systems to which the Product is applied,
- Impact of foreign objects, including damage, tears and/or abrasions, or
- Discoloration, fouling or damage that is solely cosmetic unless specified in product warranty.
PRODUCT DISCLAIMER
Any use of BULL-BOND® Products for purposes other than those specifically described by the product label, published instructions and/or technical data sheet shall render this warranty null and void. CONSPRO CORP. will not be liable for product usage recommendations by salespersons or employees that are contrary to published instructions and/or technical data sheet. The user is responsible for examining all published instructions and technical data sheets and shall determine the suitability of the product for his intended use before application and/or use. The user assumes all liabilities and risks whatsoever in connection the use and application of the product.
NON-ASSIGNABILITY
This warranty is not transferable nor assignable by contract or operation of law either directly or indirectly.
LIMITATION OF DAMAGES; MEDIATION; JURISDICTION; CHOICE OF LAW
This warranty is made in lieu of any and all other warranties, expressed or implied, including the warranties of merchantability and or fitness for use, which are hereby disclaimed. It is understood and agreed that buyer's sole remedy and therefore seller's liability whether in contract, tort, under any warranty in negligence, or otherwise, is limited to the return of the purchase price. The product warranty does not cover consequential and/or special damages or labor costs of any sort, including labor costs related to product re-application. Any and all problems, controversies, disputes or claims arising or regarding the use, warranty, recommendations, effectiveness, durability or others involving this product will be resolved only by arbitration in the Commonwealth of Puerto Rico per applicable Puerto Rico arbitration rules and proceedings in effect at the time the claim is known.

CONSPRO CORP garantiza, sujeto a los términos y condiciones aquí establecidos, que el Bull-Bond® Pro One™ sellara las filtraciones de agua por un periodo de cinco (5) años cuando el mismo se instale de acuerdo con todos los procedimientos establecidos en las instrucciones y hojas de data técnica vigentes del producto. El no seguir todas las instrucciones publicadas vigentes para el producto invalida y deja sin efecto esta garantía. CONSPRO CORP remplazará cualquier material que determine este defectuoso por uno igual o similar, o en alternativa reembolsará el precio pagado.
LÍMITE DE LA RESPONSABILIDAD DE CONSPRO CORP.
La responsabilidad de CONSPRO CORP se limita exclusivamente a reembolsar el precio pagado por el producto o remplazar el material defectuoso por uno igual o similar.
COMO REGISTRAR LA GARANTÍA
Para ser válida, el comprador debe completar y entregar la solicitud de garantía disponible en nuestros detallistas, las oficinas de Conspro Corp ubicado en la Carretera 175 Km. 0.2, Rio Cañas Industrial Park Lot #35, Caguas, 00725 Puerto Rico o en nuestra página web www.bullbond.com/warrantyproone dentro de un periodo de treinta (30) días luego de la fecha de compra del producto. El no someter la solicitud durante este periodo de treinta (30) días deja sin efecto las protecciones disponibles bajo esta garantía.
PROCESO DE RECLAMACIÓN DE GARANTÍA
Toda reclamación relacionada a productos defectuosos debe recibirse de forma escrita dentro de un periodo de un treinta (30) días luego de descubrir el fallo para ser válida. No se consideraran como válidas reclamaciones no hechas por escrito, hechas sin la solicitud de garantía correspondiente, o hechas fuera del término establecido. CONSPRO CORP investigara todas las reclamaciones validas hechas. Luego de recibir una reclamación valida, un investigador de CONSPRO CORP preparará dentro de un periodo razonable un reporte oral o escrito que detalle los problemas encontrados y una explicación por las mismas. Basándose en este reporte, un oficial autorizado de CONSPRO CORP tomara las acciones pertinentes necesarias.
RENOVACIÓN LIMITADA
Esta garantía es renovable a la discreción del comprador. Para poder pedir la renovación de la garantía, el comprador debe contactar a CONSPRO CORP para solicitar una inspección del material instalado a no menos de 180 días antes que expire el término de garantía. Un representante de CONSPRO CORP llevara a cabo una inspección de la condición del producto instalado y hará aquellas recomendaciones de re-aplicación o reparación que encuentre sean necesarias para una renovación de garantía. Una vez se lleven a cabo las acciones indicadas por el representante de CONSPRO CORP, el comprador podrá solicitar la renovación. Esta garantía es renovable a través de la vida útil del edificio o estructura. El no contactar a CONSPRO CORP para llevar a cabo la inspección requerida o el solicitar la inspección fuera del término aquí establecido invalida la porción renovable de esta garantía. La garantía solo es renovable si las renovaciones han ocurrido de forma continua e ininterrumpida a través de la vida del producto.
EXCLUSIONES DE CUBIERTA
Esta garantía no cobrara efecto en aquellos casos donde el producto se instale de forma incorrecta, sea por problemas con la mano de obra o por no seguir las instrucciones de instalación, las datas técnicas del producto, o las buenas prácticas de la industria. Comprador es responsable por cualquier mantenimiento necesario para mantener la integridad del producto y/o sistema. CONSPRO CORP no es responsable por el desgaste normal del producto o por reclamaciones de garantía que surjan de uso incorrecto o abuso del mismo. Esta garantía tampoco cubre daños o defectos que surjan por razón de:
1.Desastres naturales, plagas, caso fortuito o fuerza mayor,
2.Mal uso, abuso, o negligencia,
3.Falta de mantenimiento,
4.Agua acumulada o estancada,
5.Fuego, defecto de construcción o diseño, drenajes inadecuados o cualquier otra falta de la estructura, incluyendo pero no limitado al techo, pretiles, paredes y otros componentes,
6.Fallo del substrato del edificio o asentamientos,
7.Defectos, ampollas o delaminaciones en los materiales, substratos, capas o sistemas a los cuales se instaló el producto,
8.Impacto de objetos, incluyendo cualquier daño incidental que esto cause, o
9.Descoloración, ensuciamiento o daño que sea puramente cosmético salvo se especifique lo contrario en la garantía del producto.
DISCLAIMER
Cualquier uso de los productos BULL-BOND® para propósitos más allá de los incluidos y descritos en la etiqueta, las instrucciones publicadas y/o las hojas de data técnica corrientes constituye causa para invalidar las garantías asociadas con el producto. CONSPRO CORP no es responsable por las recomendaciones de un vendedor o empleado que sean contrarias a lo establecido en las instrucciones y/o hojas data técnica publicadas disponibles. El usuario de los productos BULL-BOND® es responsable por determinar si el producto seleccionado es el apropiado para el uso que le va a dar. El usuario asume toda responsabilidad por cualquier riesgo o daño asociado con el uso y aplicación del producto.
LÍMITES A LA TRANSFERENCIA DE LA GARANTÍA
Esta garantía no es transferible ni se puede asignar a terceros por contrato u operación de ley sea directa o indirectamente.
LIMITACIÓN DE DAÑOS; MEDIACIÓN; JURISDICCIÓN; ELECCIÓN DE FORO
Esta garantía se hace en lugar de cualquier otra garantía, expresa o implícita, incluyendo las garantías de comerciabilidad y/o aptitud para uso. El comprador entiende y acepta que el único remedio disponible, y por lo tanto la responsabilidad del vendedor bajo cualquier circunstancia, se limita al reembolso de precio pagado por el producto. Esta garantía no cubre daños consecuentes o especiales de cualquier tipo, o cualquier costo relacionado a mano de obra, incluyendo costos relacionados a la re-aplicación del producto. Cualquier problema, controversia, disputa o caso que surja o se remonte al uso, garantía, recomendación, efectividad, durabilidad u otro tema relacionado al producto será resuelto solo por medio de arbitraje. El arbitraje se llevara a cabo en el Estado Libre Asociado de Puerto Rico y bajo la reglas y procedimientos de arbitraje de Puerto Rico aplicables al momento que se dé a conocer la querella.
